POLICE are moving to secure the items seized in a raid of the home of Bella Ruby Santos, a suspect in the kidnap-murder of 6-year-old Ellah Joy Pique in barangay Inayagan, Naga City.
The Criminal Investigation and Detection Group in Central Visayas (CIDG-7) filed a motion to take custody of “the seized evidence” before Regional Trial Court Executive Judge Meinrado Paredes.
In their pleading, Chief Insp. Fermin Armendarez III said they have to secure all “electronics evidence” for forensic examination at the Anti Transnational Crime Division in Camp Crame, Quezon City.
The “electronics evidence” they recovered from Santos’ house include a Kingstone flash disk, a multireader USB card reader, five assorted memory cards, one SIM card, Nintendo DS game cartridge, 12 assorted DVDs/CDs and a video camera.
Also included were six camcorders for video purposes, a camcorder for audio purposes, a remote control, tripod, iPod charger, and black data cables, among others. Paredes has yet to rule on their request.
The CIDG-7 was earlier mandated by the court to file their comment on the motion to quash the search warrant filed by Santos.
The agency also wants to take custody of photographs, a hair strand and a 195-cm gray LAN cord for “comparison examination.
Armendarez said they also intend to take custody of the plate number of the Mitsubishi Pajero “for technical examination” before the Land Transportation Office.
The Pejero, which is under police custody, will undergo “stencil and macro etching” by the Philippine National Police crime laboratory.
The two stones taken at Santos’ garden shall undergo “technical examination” before the Department of Environment and Natural Resources (DENR).
Some biological specimens shall be sent to the Crime Laboratory in Camp Crame for “DNA test.”
These include several cut portions of mattress, blanket, toilet rugs that allegedly have traces of “boodstains.”
Armendarez asked the court to consider their request “in the interest of justice.”
Except for the Mitsubishi Parejo that was purportedly used in dumping Ellah Joy’s remains, all other items seized by authorities inside the residence in Naga, southern Cebu, have to be placed under the custody of the court as mandated by Paredes.
The CIDG-7, the judge said, may retain the Pajero with plate number LMJ-382. Roque Amante, counsel for Ellah Joy’s family, failed to file a complaint against Santos and British companion Ian Charles Griffiths before the Cebu Provincial Prosecutors' Office yesterday.
Amante earlier informed reporters that he will be filing charges against Santos and Griffiths in relation to the kidnap-murder case.
But the lawyer yesterday said he failed to finish preparing the necessary documents intended for the case.
